Website and Mobile Application Privacy Policy

Introduction

ZOOM+Care Management Inc. and its affiliates (collectively, “ZOOM+Care”) respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes: 

  • The types of information we may collect or that you may provide whent you download or use the ZOOM+Care On Demand Healthcare mobile application (the “App”), the website, zoomcare.com (the “Website”), or the features of the App and the Website.

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in the Website and App, in email, text, and other electronic communications sent through or in connection with the Website or App. 

This policy DOES NOT apply to information that:

  • We collect offline or on any other apps or websites not described in this policy.

  • You provide to or is collected by any third party.

Further, this policy does not apply to protected health information. Information that is protected health information may be subject to additional protections, and you may have additional rights regarding such information, pursuant to the federal Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (“HIPAA”), and similar state laws, as applicable.  Please refer to ZOOM+Care’s Notice of Privacy Practices for more information regarding your protected health information. 

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Website or App. By downloading, registering with, or using the Website or App, you agree to this privacy policy. This policy may change from time to time. Your continued use of the Website or App after we revise this policy means you accept those changes, so please check the policy periodically for updates. 

Medical Advice or Services

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL “911” IMMEDIATELY.  

The content of the Website and App is for informational purposes only and does not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind.  Further, the Website and App are not intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease.  You should always seek the advice of your qualified ZOOM+Care health care professional or other qualified health care professional with any questions or concerns you may have regarding your individual needs and any medical conditions.  Visiting the Website, downloading the App, or registering for a ZOOM+Care account does not create a physician-patient relationship.  Reliance on any information appearing on the Website or App, without further consultation with a ZOOM+Care health care professional, is solely at your own risk.

Children Under the Age of 13

The Website and App are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at compliance@zoomcare.com.

Authorized Representatives

An authorized representative is an individual who has the authority to create and manage a ZOOM+Care account on the Website and App on behalf of a minor child or other individual over whom the authorized individual has legal authority.  An authorized representative may include a parent, guardian, or other legal representative.

An authorized representative may authorize and/or have access to ZOOM+Care account for a dependent.  The dependent’s ZOOM+Care account will be linked to the authorized representative’s account until the earlier of the date: (i) the minor dependent reaches the age of 18, or (ii) ZOOM+Care is notified by the dependent’s authorized representative or a court of law or agency with appropriate authority that the dependent has been emancipated, attained legal custody of his or her own health information, or that a different authorized representative has been named.  Each authorized representative will have the same rights to access and communicate through the dependent’s ZOOM+Care account.  Each authorized representative agrees that if he or she becomes aware of any change in any authorized representative’s relationship to the dependent that may result in the authorized representative no longer qualifying as an authorized representative, the authorized representative will advise ZOOM+Care of the same.

Information We Collect and How We Collect It

We collect information from and about users of our Website and App:

  • Directly from you when you provide it to us.

  • Automatically when you use the Website or App. 

Information You Provide to Us  

When you download, register with, or use the App or use or register through the Website, we may ask you provide information by which you may be personally identified, such as name, postal address, email address, telephone number, and information related to your health care (“personal information”).

This information includes: 

  • Information that you provide by filling in forms in the Website or App. 

  • Records and copies of your correspondence (including email addresses and phone numbers and messages sent via ZOOM+Care’s chat features), if you contact us.

Automatic Information Collection and Tracking  

When you download, access, and use the App or access or use the Website, the App or Website may use technology to automatically collect:

  • Usage Details. When you access and use the App or Website, we may automatically collect certain details of your access to and use of the App or Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App or Website. 

  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.  However, we do not link your IP address to your personal information unless you have logged into your ZOOM+Care account.

  • The App also may access metadata and other information associated with other files stored on your device.

  • Location Information. The App or Website may collect time information about the location of your device. 

If you do not want us to collect this information do not use the Website or do not download the App or delete it from your device. Note, however, that opting out of the App’s collection of location information will disable its location-based features.

Information Collection and Tracking Technologies 

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our Website or App. 

  • Flash Cookies. Certain features of our Website may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Website. Flash cookies are not managed by the same browser settings as are used for browser cookies.

  • Web Beacons. Pages of the Website, the App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit ZOOM+Care, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

Third-Party Information Collection

When you use the Website, App or their content, you may be directed to our third-party payment processor to handle payment transactions with ZOOM+Care.  Any payment transactions will be subject to such third-party payment processors’ privacy policies and terms and conditions.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Website, App and their contents, and any other information, products or services that you request from us.

  • Develop, provide, and improve our services, conduct internal reviews of our services, and protect the security and integrity of our services.

  • Manage and verify your account and the identity of users of the services.

  • Contact you when necessary about your account or your use of the services.

  • Send you information and promotional materials about our services as well as ZOOM+Care in general.

  • Respond to support requests.

  • Comply with regulatory requirements for the maintenance of records.

  • Fulfill any other purpose for which you provide it.

  • Give you notices about your account, including appointment reminders and notifications regarding test results.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.

  • Any other legal, business, or marketing purposes that are not inconsistent with this policy.

We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. We may use the information we collect to display advertisements to our advertisers' target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. 

In addition, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ZOOM+Care’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by ZOOM+Care about our users is among the assets transferred.

  • To third parties to market their products or services to you

  • To fulfill the purpose for which you provide it. 

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, and for billing and collection.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of ZOOM+Care or others. 

  • To provide you with information and promotional materials about our products and services as well as our company in general.

  • With third parties who conduct marketing studies and data analytics. These third parties may combine your information with the information of other consumers for purposes of conducting these studies and/or analytics. For example, we use certain Google products to track and report activity within the Services. If you wish to opt out of having your data used by Google Analytics, you may download and install on all your browsers the Google Analytics Opt-out Browser Add-on developed by Google for this purpose, available at https://tools.google.com/dlpage/gaoptout/.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information. 

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Website or App may then be inaccessible or not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Your browser or mobile device may allow you to adjust your settings so that “do not track” requests are sent to the websites you visit.  ZOOM+Care will not track user activity once “do no track” signals have been activated.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
